How to Join a Class Action Lawsuit

If you’ve received a legal notice in the mail or heard that a company you did business with is being sued, you might be wondering how to join a class action lawsuit. The process is simpler than most people expect. But there are a few details that matter most .

First consideration: opt-in or opt-out?

Most U.S. class actions are what is called “opt-out.” If you fit the class definition, you’re automatically included unless you formally want to remove yourself. Some cases are “opt-in,” meaning you must take a step to join. Knowing which type you’re dealing with is the first thing to know. If you are unsure, ask us.

Confirm if you’re a class member

The “class notice” describes exactly who qualifies. For example, “anyone who bought Product X between 2022 and 2025.” Read that definition carefully to see if you fit in.

Watch for the arrival of class notice (and don’t ignore it when you get it)

Notices arrive by mail or email or may appear on a settlement website. It’s easy to mistake an incoming notice as junk mail. Don’t make that mistake. It might be your only window of opportunity to act.

File your claim before the deadline

In most settlements you must submit a claim form (often online) by a clearly stated deadline in order to receive payment. Missing a deadline usually means getting nothing, even if you were qualified.

Decide whether to stay in or opt out

Staying in is usually easy and free, but you give up the right to sue individually. If your losses are much larger than the average class member’s, opting out and pursuing your own claim may make more sense. This is where decisive legal advice pays off.

What’s the costs?

Joining a class action typically costs nothing up front. The class counsel is paid from what is recovered. Filing a claim form is free.

When When should I call a lawyer instead of just filing a form?
